Terms of Use

These Terms of Use (the “Terms”) form a binding agreement between you and Color Hub
and govern your access to and use of our website (colorhub.online) and Color Hub applications
(collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not
agree, do not use the Services.
1. Overview
“Color Hub”, “we”, “us”, or “our” refers to Color Hub operated by Luka
Katsadze (sole proprietor), Tbilisi, Georgia. “You” or “User” means anyone accessing or using the
Services.
We may update these Terms from time to time. When we do, we’ll post the updated
Terms and update the “Last updated” date above. If changes are material, we’ll provide a prominent notice and
such changes will take effect no earlier than 15 days after notice, except where earlier effectiveness is
required for legal, security, or safety reasons. Your continued use of the Services after the effective date
means you accept the updated Terms.

2. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of
majority in your jurisdiction, you may use the Services only with the consent of a parent or legal guardian.
If you are using the Services on behalf of an organization, you represent that you have authority to bind that
organization to these Terms. The Services are not intended for children under 13, and we do not knowingly
collect personal data from children under 13. If you believe a child has provided us personal data, please
contact us and we will delete it.
3. Accounts
Some apps may require an account for certain features; others may not. You agree to
provide accurate information and to keep your credentials secure. You are responsible for all activity under
your account.
4. License and acceptable use
Subject to these Terms, we grant you a personal, revocable, non-exclusive,
non-transferable, non-sublicensable license to use the Services. You agree not to:
- copy, modify, reverse engineer, or create derivative works from the Services except as permitted by law;
- remove notices or circumvent security or rights‑management features;
- use bots, scrapers, automated means, or perform load/stress testing without our prior written permission;
- send spam or unsolicited communications via the Services;
- interfere with, disrupt, or compromise the security or integrity of the Services;
- access or use the Services in violation of law or to infringe others’ rights;
- circumvent paywalls, subscriptions, or access controls;
- attempt to gain unauthorized access to any service, data, account, or network;
- resell, sublicense, or otherwise transfer the Services except as expressly allowed.
We may determine, in our discretion, whether conduct violates these Terms.
5. Intellectual property
All rights, title, and interest in and to the Services and our content (including
software, text, graphics, logos, and trademarks) are owned by or licensed to Color Hub.
You retain ownership of content you submit to the Services (“User Content”). By
submitting User Content, you grant us a limited, worldwide, non‑exclusive, royalty‑free license to host,
store, display, and process it solely to operate and improve the Services and for security and
abuse‑prevention purposes. You are responsible for your User Content and represent that you have all rights
needed to grant this license. We may remove or disable access to User Content that we reasonably believe
violates these Terms or applicable law.
6. Privacy
Your use of the Services is also governed by our
Privacy Policy. It explains what personal data we process and why, including analytics
and diagnostics used in our apps. We do not use marketing analytics on the website.
7. Updates
We may provide updates, upgrades, patches, and other changes to the Services
("Updates"). Updates may add, change, or remove features. You agree to install critical Updates promptly.
Updates are part of the Services and are subject to these Terms.
8. Third‑party services and platforms
The Services may link to or rely on third‑party services (e.g., app stores, CDNs).
Your use of those services may be governed by their terms. Platform providers (such as Apple or Google) are
not responsible for providing maintenance or support for our apps, and to the extent permitted by law, have no
liability for our apps. To the extent required, your use of our iOS apps is also subject to the Apple Media
Services EULA.
9. Changes, suspension, and termination
We may add, change, or remove features, and may suspend or terminate the Services
(in whole or in part) at any time. You may stop using the Services at any time. We may suspend or terminate
your access if you violate these Terms.
10. Disclaimer of warranties
Except to the extent permitted by applicable law, the Services are provided “as is”
and “as available,”
without warranties of any kind, whether express, implied, or statutory, including implied warranties of
merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Services
will be uninterrupted, secure, or error‑free.
11. Limitation of liability
To the maximum extent permitted by applicable law, Color Hub and its officers,
employees, and
agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any
loss of profits, revenue, data, or use, arising out of or related to the Services or these Terms, even if
advised of the possibility of such damages. Our total liability for any claims relating to the Services will
not exceed the amounts you paid (if any) for the Services during the 12 months before the event giving rise to
liability. Nothing in these Terms excludes or limits liability for willful misconduct, gross negligence, death
or personal injury, or for any liability that cannot be excluded or limited under applicable law (including
certain consumer protection rights).
12. Indemnity
You agree to protect, defend, indemnify and hold harmless Color Hub and its
officers, directors, employees, agents from and against any and all claims, demands, costs, expenses,
losses, liabilities, and damages of every kind and nature (including, without limitation, reasonable
attorneys’ fees) imposed upon or incurred by Color Hub directly or indirectly arising from (i) your use of
the Services; (ii) your violation of any provision of these Terms; and/or (iii) your violation of
any third-party right, including without limitation any intellectual property or other proprietary rights.
The indemnification obligations under this section shall survive any termination or expiration of these
Terms or your use of the Services.
13. Availability and force majeure
Subject to these Terms and our policies, we
shall use commercially reasonable efforts to provide the Services on a 24/7 basis. You
acknowledge and agree that from time to time the Services may be inaccessible for any reason
including, but not limited to, periodic maintenance, repairs or replacements that we undertake from time
to time, or other causes beyond our control including, but not limited to, interruption or failure of
telecommunication or digital transmission links or other failures, acts of God, natural disasters, war,
terrorism, labor disputes, governmental actions, or power outages.
You acknowledge and agree that we have no control over the availability of the
Services on a continuous or uninterrupted basis and that we assume no liability to you or any other
party with regard thereto.
15. Compliance with local laws
Color Hub makes no representation or warranty that all the content available on
the Services is appropriate in every country or jurisdiction, and use of the Services from
countries or jurisdictions where its content is illegal is prohibited. Users who choose to use the
Services are responsible for compliance with all local laws, rules, and regulations.
16. Governing law
These Terms and any dispute arising out of or related to them or the Services are
governed by the laws of Georgia, without regard to conflict of laws principles.
17. Miscellaneous
Titles and headings are for convenience only. If any provision is found
unenforceable, the remaining provisions will remain in full force. You may not assign or transfer these Terms
or any rights hereunder without our prior written consent. We may assign or transfer these Terms (in whole or
in part) in connection with a merger, acquisition, reorganization, or sale of assets. These Terms constitute
the entire agreement
between you and Color Hub regarding the Services and supersede prior agreements on the same subject.
18. Limitation of time to file claims
Where permitted by law, any cause of action or claim you may have arising out of or
relating to these
Terms or the Services must be commenced within one (1) year after the cause of action accrues; otherwise such
cause of action or claim is permanently barred.
