Quote Flow Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Quote Flow application for iOS, Android, and the web (the "Application"), provided by Color Hub, operated by Luka Katsadze, a sole proprietor based in Tbilisi, Georgia ("we", "us", or "our"). By downloading, installing, creating an account, or otherwise using the Application, you agree to these Terms. If you do not agree, do not use the Application. These Terms include the licence under which the Application is made available to you and serve as its end-user licence agreement.

1. Definitions

"Application" means the Quote Flow mobile and web app and any related services we provide. "You" or "User" means the natural person using the Application. "App Store" means the platform you obtained the Application from. "Content" means any quote, note, tag, image, idea, or other material you create, upload, or store through the Application. "Feed" means the published quotes we show in the Application.

2. Eligibility

You must be at least 13 years old to use the Application. Where the minimum age of digital consent under the EU GDPR is higher in your country, users below that age may use the Application only with the consent of a parent or legal guardian.

3. Your Account

The Application starts with an anonymous account that is tied to one installation; its data may be lost if you remove the Application or sign out. Link a sign-in method to keep it. You are responsible for keeping your credentials confidential and for all activity under your account. Tell us promptly at support@colorhub.online about any unauthorised access. You can delete your account at any time in the Application's settings or by emailing us.

4. Acceptable Use

You agree not to, and not to attempt to:

  • use the Application in violation of any applicable law;
  • reverse-engineer, decompile, or otherwise attempt to derive the source code of the Application, except where mandatory law allows it;
  • copy, modify, distribute, sell, or lease any part of the Application, except as these Terms permit;
  • circumvent any security feature, usage limit, paywall, or access control;
  • submit ideas or other content that is unlawful, infringing, hateful, harassing, sexually explicit, or spam;
  • use the AI features to generate unlawful content or to overload or abuse the service;
  • access the Application by automated means (bots, scrapers) without our prior written consent.

We may suspend or terminate your access if you materially breach these Terms.

5. Your Content and Quotes by Others

You keep all rights in your Content. You grant us a worldwide, non-exclusive, royalty-free, limited licence to host, store, transmit, back up, and display your Content solely to provide the Application to you (including syncing and the AI features you use), to show approved ideas on the ideas board, to keep the service secure, and to comply with law. The licence ends when you delete the Content or your account, subject to the retention described in our Privacy Policy.

Quotes are usually the words of other people and may be protected by copyright. The Application is meant for keeping quotes for personal use. If you share or publish a quote outside the Application, you are responsible for doing so lawfully and for crediting its author. Quotes in the Feed belong to their authors or rights holders and are shown for personal reference.

6. AI Features

AI suggestions, extracted text, and assistant replies are generated automatically and may be wrong, including the author or source of a quote. The assistant changes your collection only when you ask it to, and you remain responsible for checking its results. AI use is subject to the limits of your plan shown in the Application.

7. Intellectual Property

The Application, including its software, design, text, graphics, logos, and trademarks (such as "Quote Flow" and "Color Hub"), is owned by us or our licensors. Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to use the Application for your personal, non-commercial purposes. Images you create with the Application's share feature may be used for personal, non-commercial purposes. All rights not expressly granted are reserved.

8. Subscriptions and Billing

The Application offers optional auto-renewing subscriptions that unlock premium features and higher AI limits. Price, billing period, and any free trial are shown at the point of purchase and may vary by region and over time.

  • Auto-renewal. Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period.
  • How to cancel. Manage or cancel your subscription in your Apple App Store or Google Play account settings. Deleting the Application or your account does not cancel a subscription.
  • Free trials. Any unused portion of a free trial is forfeited when you start a paid subscription, unless mandatory consumer law provides otherwise.
  • Refunds. Refunds are processed by Apple or Google under their policies. Your statutory rights, including the EU/UK 14-day cancellation right described in our Privacy Policy, are not affected.
  • Price changes. We will give you advance notice of a price change before it applies to you and, where required, ask for your consent.
  • Limits. The free plan has limits on the number of quotes and AI requests, shown in the Application. Paid plans may include a fair-use cap that protects the service from abuse.

9. Third-Party Services

The Application relies on third-party services subject to their own terms, including Google Firebase, Google Cloud (Vertex AI), RevenueCat, and Sentry.

10. Connectivity, Updates and Availability

Some functions need an internet connection; we are not responsible for charges from your network provider. We may release updates, change supported platforms, and add or remove features. You may need to install updates to keep using the Application. We do not guarantee that the Application will always be available.

11. Termination

You may stop using the Application and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, if there is a serious security or fraud risk, or if we discontinue the Application. If we terminate your access to a paid feature for reasons other than your breach, we will refund the pro-rata portion of any prepaid fee for the period after termination.

12. Disclaimer of Warranties

The Application is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of the Feed or AI output. If you are a consumer in the EU or UK, your statutory rights are not affected.

13. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of the Application or these Terms. Our total liability shall not exceed the greater of the amount you paid us in the 12 months before the claim and one hundred US dollars (USD 100). These limits do not apply to liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited by law.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, your Content (including quotes you share outside the Application), or your violation of anyone's rights or of any law. This does not apply where consumer law prohibits such an indemnity.

15. Governing Law and Disputes

These Terms are governed by the laws of Georgia, without regard to its conflict-of-laws principles. If you are a consumer whose country's mandatory consumer law applies to you, you keep its protection. Please contact us first at support@colorhub.online to try to resolve any dispute. Otherwise, disputes go to the competent courts of Tbilisi, Georgia, or, if you are a consumer, to the courts of the country where you live. EU consumers may also use the Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

16. Apple App Store Terms

If you obtained the Application from the Apple App Store, these Terms are between you and us only, not with Apple Inc. ("Apple"), and we alone are responsible for the Application. Apple has no obligation to provide maintenance or support. If the Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation to the extent permitted by law. Apple is not responsible for any claims relating to the Application, including product liability, regulatory, consumer protection, or intellectual property claims. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Your use must also comply with the Apple Media Services Terms and Conditions.

17. Changes to These Terms

We may update these Terms from time to time and will post the updated version on this page with a new "Last updated" date. For material changes, we will give reasonable advance notice. If you do not agree, stop using the Application before the changes take effect.

18. Miscellaneous

These Terms and our Privacy Policy are the entire agreement between you and us about the Application. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may assign them in a merger, acquisition, or sale of assets without reducing your rights. The English version is authoritative.
